MT EVENTS TERMS AND CONDITIONS
Deposit & Payment Terms
Deposit: A 65% non-refundable deposit is required within 7 days of invoice to secure any booking.
Balance: The remaining 35% is due no later than 7 days before the Event.
For bookings made within 7 days of the Event, full payment is required immediately.
Failure to pay on time may result in cancellation at MT Events' discretion.
Cancellations & Limitation of Liability
Cancellations must be made in writing.
Cancellations within 30 days of the Event: 100% of Event Invoice is payable.
Cancellations more than 30 days before the Event: Deposit is forfeited.
If MT Events cannot provide the booked artist due to unforeseen circumstances, a suitable replacement will be offered or a refund issued.
Bump In / Set Up
Standard bump-in is 60 minutes before the Event.
Earlier setup will incur an additional fee
Overtime
Extensions requested within 48 hours of the Event are charged at 1.5x the original hourly rate.
Overtime must be approved and paid as invoiced after the Event.
Parking
The Purchaser must provide convenient parking. Parking fees above $20 will be charged to the Purchaser.
Outdoor Events
The Purchaser must ensure safe conditions for outdoor events, including shelter for equipment.
MT Events may cancel or stop the Event if weather conditions pose risks.
Price Variations
Additional costs (e.g., early setup, extra hours) may be added to the Event Invoice.
Reductions in booked time will not reduce fees.
Conduct
Aggressive or unsafe behavior may result in immediate termination of the Event with no refund.
The Purchaser is liable for any damage to MT Events' property or equipment caused during the Event.
Privacy
We may collect and disclose customer information in accordance with the Privacy Act 1988 for operational and legal purposes.
Force Majeure
MT Events is not liable for failure to perform due to circumstances beyond reasonable control (Force Majeure Events).
Sites
The Purchaser must ensure all sites are safe and compliant with health and safety laws.
Intellectual Property
MT Events retains all rights to materials provided.
The Purchaser grants MT Events a license to use any materials supplied by the Purchaser to fulfill obligations.
GST Not Charged
Prices are GST exclusive unless otherwise stated.
Termination
Either party may terminate for material breach, insolvency, or serious risk to personnel.
Early termination by the Purchaser will require full payment of the agreed contract term.
Liability
Liability is limited to the value of the Event Invoice.
MT Events is not liable for indirect, consequential losses, or health-related interruptions.
Claims must be made within one month of the Event.
Miscellaneous
These terms are governed by the laws of Victoria, Australia.
If any part is found unenforceable, the rest remains in effect.
No set-off rights apply.
No assignment of rights by the Purchaser without consent.
Both parties must do all things reasonably necessary to give effect to this agreement.
Definitions
Force Majeure Event: Includes natural disasters, pandemics, extreme weather, terrorism, civil unrest, etc.
Goods: Any goods supplied by MT Events.
Services: Services provided by MT Events including Musicians, DJs, Roving Performers, Photographers, Photo Booths, and more.
Your Sites: Venues where services are provided.
